The Cabinet of Ministers of Ukraine adopted a decree dated December 23, 2020, which amended a number of other government decrees in the field of intellectual property.
So, from the decree on state registration of copyright and contracts that relate to the author’s right to works, the rule that the Ministry of Economic Development, Trade, and Agriculture of Ukraine is engaged in actions related to such registration is completely excluded.
The Ministry of Economy itself initiated such changes since a new body is in the process of creation – the National Intellectual Property Body (NOIV). The law stipulates that it is NOIV that will carry out all actions that are related to the registration of the author’s rights to works of science, literature, and art, as well as the registration of contracts that relate to the author’s right to work.
In addition, a number of other powers that previously belonged to the Ministry of Economy are transferred to the National IP Agency:
- Preparation, certification, registration of patent attorneys.
- Maintaining the State register of patent attorneys.
- Maintaining state registers in the field of intellectual property.
- Issuance of patents and certificates.
