The Antimonopoly Committee of Ukraine recognized the copying of the packaging design of competitors’ products and fined the private enterprise Divotsvit for violation of the legislation on protection against unfair competition for UAH 1.658 million.
The committee found out that Henkel Bautechnik LLC has been producing Metylan glue in packaging since 2013. At the same time, PE “Divotsvit” has been producing wallpaper adhesives in packaging with a similar design only since 2020. At the same time, Henkel Bautechnik did not grant permission to use such a design.
Since such similarities may lead to confusion with the applicant’s activities, the Committee found that Divotsvit used the design of adhesive packages: MetaFix Flizelin Premium, MetaFix Vinyl Indicator, MetaFix Universal Special as a violation of the Law on Protection against Unfair Competition.
In addition to paying the fine, PE “Divotsvit” is obliged to stop the violation within two months.
