On November 25, 2019, the President of Ukraine signed a law amending the Criminal Code regarding liability for counterfeiting drugs or trafficking in counterfeited drugs.
So, the stipulated term of imprisonment for the manufacture, purchase, transportation, shipping, storage for the purpose of sale or the sale of knowingly counterfeited medicines is increased to 5-8 years.
For the same actions committed repeatedly or in collusion by a group of persons, or by an official, a medical or pharmaceutical worker, or through mass distribution channels, including over the Internet provides liability from 8 to 10 years of imprisoned with confiscation of property.
If counterfeit medicines lead to death – a sentence of imprisonment of 10 to 15 years or life imprisonment with confiscation of property.
According to various estimates, up to 10% of medicines in Ukraine are counterfeit.
