State Register of Industrial Property Objects of the Republic of Kazakhstan contains more than 67 thousand registered trademarks. More than half of them were registered by foreign applicants.
At the same time, according to official statistics, provisional and final refusal in registration are issued for each second application.
Much common reason for refusal – applied sign is identical or confusingly similar to the filed trademark applications or registered trademarks in respect of similar goods and services in Kazakhstan. Also, it is not possible to register signs which are similar to the trademarks recognized as well-known.
There are two options to conduct the preliminary search before filing a trademark application in Kazakhstan: order an official search in national and international databases, or do preliminary online trademark searches on the website of the National Institute of Intellectual Property (Kazpatent).
Official Trademark search in Kazakhstan
In Kazakhstan word, device, and combined signs could be registered.
The Patent Office of Kazakhstan carries out an official preliminary search for trademarks. The search includes the provision of information on both registered and just filed applications.
The search will be conducted in national and international databases.
Official fee depends on term of search, number of classes and type of mark.

If the image as part of the combined mark contains several elements requiring a search for additional classes, then the cost of searching for such a designation in relation to one class will be 215USD, and 20USD for each additional class.
Preliminary online trademark search in Kazakhstan
State Register of Industrial Property Objects of Kazakhstan provides the possibility of searching for information on registered industrial property objects, incl. trademarks, well-known trademarks, appellations of origin.
Additionally, the online database provides the possibility of searching for information on registered contracts on the disposal of exclusive rights to trademarks and industrial property.

Search results will appear below the search bar in the form of text cards.
As a result of the search, a card with brief information about the industrial property is displayed.
The search contains information about the granted certificate/application, name and image of a trademark holder, patent attorney, etc. Also, the card contains information about changes in the data of an object, as well as information about registered exclusive rights to a trademark.
Note, that nevertheless interface of online database is available on English, all information in the register is conducted on Russian and Kazakh.
Online database shows information on registered and published trademarks which passed formal examination.
Also, Kazakhstan joined the Madrid Agreement concerning the International Registration of Marks. State Register does not contain information on trademarks registered using the Madrid system on the territory of Kazakhstan.
