The Antimonopoly Committee of Ukraine fined DKP PHARMACEUTICAL FABRYKA LLC for improperly using the design of the packaging of the drug “KORVALAZID”, similar to the design of the packaging of the drug “KORVALOL” of another Ukrainian pharmaceutical company FARMAK JSC.

The Committee started the case on the basis of a statement from FARMAK, which complained about the competitor’s actions. According to the applicant, the competitor used the design of the packaging of the drug “KORVALAZID”, which is similar to the degree of confusion with the design of the packaging of the drug “KORVALOL”, which has been present on the market for a long time.

At the same time, FARMAK did not grant permission to use a similar design of the packaging of the medicinal product “KORVALOL”.

The Antimonopoly Committee recognized that such actions could lead to mixing the activities of both companies and give DKP FARMACEVTYCHNA FABRIKA unfair advantages in competition due to the use of someone else’s business reputation.

The Antimonopoly Committee imposed a fine of UAH 485,387 ($13,400) on the infringer.
