Uzbekistan joined Patent Cooperation Treaty (PCT) and offers the option to obtain a patent based on an international patent application.
Entry into the national phase in Uzbekistan is possible within 31 months from the priority date.
Uzbekistan Patent Office accepts patent applications both for inventions and utility models.
Uzbekistan is not a member state of any regional patent systems, like EPO or Eurasian Patent Organization. So, the only possibility to obtain protection for a patent is PCT national phase or direct national application.
The patent materials for filing to Uzbekistan Patent Office should be translated into Russian or Uzbek. The translation into only one language is required.
The applicant, who is a non-resident of Uzbekistan, has to hire a local licensed patent attorney.
Documents for PCT national phase in Uzbekistan
The documents required: description, claims (if amended, as amended only), any text matter of drawings, and abstract.
For non-residents, a power of attorney in the name of an Uzbek patent attorney is required. No legalization or notarization is needed. Uzbekistan IP Office requires scan copy and an original copy of a POA.
Duration of the registration procedure
The procedure of obtaining a patent for the invention includes a formal examination, substantive examination, and patent issuing. For utility model: formal examination and registration only.
Substantive examination in Uzbekistan is carried out at the request of the applicant, which must be submitted to the Office when submitting the application or within 3 years from the date of filing the application.
If a patent application complies with the patentability criteria, a decision is made to grant a patent.
The duration of all stapes is 2-4 years after the filing date. Possible expert requests could slow down the procedure.
A patent for an invention in Uzbekistan is valid for 20 years from the filing date. The term of a patent can be extended at the request of the applicant for additional 5 years if the invention relates to a drug or pesticide.
The annual fees must be paid annually, starting from the third year.
