According to Lyudmila Zaporozhets, Head of the Department for Ensuring Judicial Protection of Intellectual Property Rights of the Department for Protection of Intellectual Property Rights of UKRNOIVI, in Ukraine, cases on intellectual property rights protection are usually considered for at least 2-3 years (59% of cases), but this period can last 3-5 years (30% of cases), and even more than 5 years (11% of cases).
In addition, there is a trend towards an increase in the filing of claims compared to 2022.
The Ukrainian National Office of Intellectual Property and Innovations (UKRNOIVI) participates in the consideration of the majority of cases in the field of protection of IP rights, which are considered in Ukraine in courts of all jurisdictions.
In 2023, to ensure the representation of the interests of UKRNOIVI, 87 claims were processed, on which proceedings were initiated, while in 2022 there were 62 claims.
The largest number of legal disputes concerns the invalidation of trademark certificates (28%) and the early termination of TM certificates (20%).
As of November 1, 2024, the IR office received 61 claims.
The total number of legal cases in which UKRNOIVI is currently participating is 198.
