The auto concern Daimler and the manufacturer of hydraulic equipment KYB have lost a lawsuit against the Federal Antimonopoly Service of Russia (FAS) to challenge the FAS ruling on the import of repair parts.
In 2020, the FAS commission considered two cases on complaints from independent importers, to whom KYB Corporation and Daimler AG refused to conclude an agreement on the import of original auto parts to Russia without giving any reason.
The FAS considered this to be unfair competition and issued an order to adopt regulations for considering such appeals from independent importers.
The auto concern contested this decision of the FAS, noting that the legalization of parallel imports poses a threat to the safety and health of the consumer, negatively affects the development of the market and the localization of production.
Daimler also intends to challenge this decision of the Moscow Arbitration Court.
