The Antimonopoly Committee of Ukraine recognized that “Behealth” LLC violated the Law of Ukraine “On Protection from Unfair Competition” by spreading misleading information, by posting on the website and the packaging of the dietary supplement “Feminozide” false information about the properties of this dietary supplement.
AMCU established that “Behealth” LLC disseminated misleading information by reporting:
- on the packaging of the dietary supplement false information “contributes to the general strengthening of the body” and “contributes to the strengthening of immunity”;
- on the website false information: “help with diseases caused by the human papillomavirus, including the oncogenic type (HPV)”; “help with diseases caused by herpes viruses of various types (Herpes simplex, Herpes Zoster, Epstein-Barr virus, cytomegalovirus)”; “prevention of relapses caused by the human papillomavirus, including the oncogenic type (HPV)”; “prevention of relapses caused by herpes viruses of various types (Herpes simplex, Herpes Zoster, Epstein-Barr virus, cytomegalovirus)”; “Feminozide is an improved formula for etiopathogenetic support of women with urogenital viral diseases”; “contributes to the general strengthening of the body”; “contributes to the strengthening of immunity.
In response to the request, the Ministry of Health of Ukraine said that it is possible to confirm the manufacturer’s message only based on scientific research. The Ministry does not have any information about the results of such studies.
In addition, the presence of pharmacological and immunological effects is characteristic of medicinal products, not food products. The dietary supplement “Feminozide” is not registered in the territory of Ukraine as a medicinal product.
It is worth noting that ” Behealth ” LLC did not provide the Committee with adequate evidence to confirm the properties of the dietary supplement, taking into account the peculiarities of its composition.
AMCU recognized the actions of ” Behealth ” LLC as a violation of the legislation on protection against unfair competition and imposed a fine of UAH 450,000. During the investigation of the case, “Behealth” LLC stopped distributing information about the properties of the dietary supplement.
The case was initiated at the request of another Ukrainian producer, NVK Ecopharm LLC.
