One of the most pressing issues for Uzbekistan is the acceleration of its accession to the World Trade Organization and the need to align national legislation with WTO norms.
In this regard, based on the requirements of the Agreement on Trade-Related Aspects of Intellectual Property Rights, appropriate amendments and supplements are being made to the laws of the Republic of Uzbekistan “On Inventions, Utility Models and Industrial Designs” and “On Trademarks, Service Marks and Appellations of Origin of Goods”, which provide for the definition of a specific procedure for using the right to industrial property objects without the consent of its owner, taking into account the interests of the rightsholders and the removal of the limitation period for protecting rights in case of unfair registration of trademarks by other persons.
The Law “On State Duty” is being amended to unify the amounts of patent fees, as well as the amounts of state fees charged for state registration of enterprises with foreign investments and other business entities.
Thus, from January 1, 2025, separate fees for non-residents of Uzbekistan, which were several times higher than the fees for residents of the country, will cease to apply, and the fees will depend on whether the applicant/owner is an individual or a legal entity.
In particular, the fee for filing an application for a trademark in one class for legal entities will be approximately US$180 and US$120 for individuals. Currently, this fee for non-residents is about US$710. The fee for publication and registration will be about US$340 for legal entities and $200 for individuals. Currently, this fee for non-residents exceeds US$1,400.
The fee for extending the validity period of a TM certificate will decrease from about US$660 as of today to US$180 or 120.
