On August 14, 2025, the Antimonopoly Committee of Ukraine adopted a decision recognizing the actions of Gledpharm Ltd. and Ilan Pharm Ltd. as violations of the Law of Ukraine “On Protection Against Unfair Competition” in the form of the dissemination of misleading information.
In particular, Gledpharm Ltd. disseminated misleading information by communicating to an indefinite circle of consumers false statements regarding the properties of the dietary supplement “Sakhnil”: “contributes to the normalization of elevated blood sugar levels”; “contributes to the improvement of carbohydrate metabolism, normalization of elevated blood sugar levels, improvement of metabolism and reproductive function. It may be used as a supplement in a program of measures aimed at reducing blood sugar levels. Possesses antioxidant properties”; “contributes to the improvement of carbohydrate metabolism”.
Ilan Pharm Ltd. placed false statements on the packaging and in the package insert of the cosmetic product “Herpemax Cream-Balm 15 g”, namely: “a combined remedy for the prevention of herpes”.
According to information provided by the Ministry of Health of Ukraine, the above-mentioned property indicates a pharmacological effect of the product. A product positioned as having such properties cannot be classified as a cosmetic product, since such products fall within the scope of the Law of Ukraine “On Medicinal Products” and must be included in the State Register of Medicinal Products of Ukraine.
The Antimonopoly Committee imposed a fine of UAH 5.421 million (USD 132 thousand) on Gledpharm Ltd. and ordered the company to cease dissemination of misleading information. Ilan Pharm Ltd. was fined UAH 2.22 million (USD 54 thousand).
