The Antimonopoly Committee of Ukraine has provided recommendations to CJSC Pervomaisky Dairy Canning Plant and CJSC Khmelnitskaya Maslosyrbaza, which use condensed milk packaging similar in style from other manufacturers: LLC Milk-Invest and CJSC Ichnya Milk Canning Plant.
The companies began releasing products with this design in 2019, while competitors’ packaging that was too similar appeared on the market at the end of 2020.
Most manufacturers of sweetened condensed milk use the graphic style and colors of the Soviet times when decorating their product packaging, adding some of their own label design elements.
Pervomaisky Dairy Canning Plant and Khmelnitskaya Maslosyrbaza used labels not only with these recognizable elements, but also unique elements from competitors’ labels without their permission.
In particular, these are elements in the form of ribbons with an inscription, medals, placement of trademarks, images of strawberries in splashes of milk. These elements were placed on labels in the same places as similar elements of competitors.
The Committee provided Pervomaisky Dairy Canning Plant and Khmelnitskaya Maslosyrbaza with recommendations to stop using these elements of label design, or a case on violation of the legislation on the protection of economic competition will be initiated.
