California company Mattel Inc., a manufacturer of toys under the trademark Barbie, faced problems when registering a Trademark in Ukraine. As it turned out, this TM was registered by the Ukrainian food company Yasen in transliteration – BARBI (Ukrainian БАРБІ) in 2003.
The company Yasen is a producer of confectionery, soft drinks, mineral water, groceries. It registered TM BARBI back and sells marmalade under this sign.
The American company appealed to the Ukrainian court with a claim to cancel the registration of TM BARBI for a part of the classes in which this sign is not used.
