The Federal Antimonopoly Service (FAS) of the Russian Federation saw signs of unfair competition in the positioning of antibacterial soap from Cotton Club LLC.

On the packaging of the liquid soap “AURA antibacterial” there is an inscription “ANTIBACTERIAL BRAND № 1 IN RUSSIA”.

However, during the proceedings, the Cotton Club was unable to confirm that this allegation was based on objective evidence. Such an inappropriate comparison with competitors’ products is violation of law on advertising.

The FAS explained that it is possible to declare such a thing only if a measurable criterion by which the products are compared is clearly indicated. If there is no objective data behind the statement, such advertising gives the product an unfair advantage.

FAS fined the manufacturer 250 thousand rubles, and also its general director was fined 12 thousand rubles.
